Collision of the ship Ulysse with CLS Virginia: damage will be reimbursed by insurance

On Sunday, October 7th, 2018, the Tunisian 162m long freighter, Ulysse, owned by the Tunisian Company of Navigation (COTUNAV), collided with the Cypriot container ship CLS Virginia. The accident occurred about 28 km north of Cape Corsica.

On Thursday, October 11th, the two ships, which had remained wedged together, were disentangled under the effect of waves and attempts to pull them apart. The hole left on the right side of the CLS Virginia leaked between 40 and 200m3 of fuel.

In the event of a ship accident, shipowners are covered by the Protection and Indemnity Club (P&I Club), a non-profit association of marine insurers. The risks covered include:

  • collisions
  • stranding and shipwrecks
  • towing
  • pollution from the ship
  • civil liability of the goods
  • deaths and bodily injuries

Once investigation is over and the liabilities are determined, insurers of the ship that is responsible for the accident start making the various compensations. In the case of Ulysse's collision with CLS Virginia, the amount of compensation could reach 40 million TND (14.19 million USD), excluding compensation for marine pollution.

It should be noted that the Cypriot shipowner obtained provisional seizure of the vessel Carthage, another property of COTUNAV, in order to force the Tunisian carrier to give him a letter of guarantee of reimbursement pending the results of the expert appraisal proving or not responsibility for the collision.
