On 22 December 2020 The Commercial Court of Annecy handed down a decision for AXA France to compensate the covid-19 related business interruption of a hotelier/restaurateur.
The insurer is to pay 60 000 EUR (67 191 USD) to the plaintiff pending a final assessment of the amount of the losses.
This is the first conviction under a contract applicable to hoteliers-restaurateurs, different from the one applicable to restaurateurs.
For the record, AXA’s insured restaurateurs have filed many complaints against the French insurer. Some courts have ruled against while others have ruled in its favour.
