AXA France to compensate business interruption losses of a restaurant owner

AXAUnder orders of Paris Commercial Court issued on 22 May 2020, AXA France is required to refund Stéphane Manigold, a Parisian restaurant owner and president of Eclore group.

The culinary group, which has been out of service since late 14 March, was being faced with the refusal of its insurer AXA to cover its losses.

The insurance policy, ambiguously worded, on the one hand states that the insurer must cover business interruption in case of systemic closure imposed by police, health or safety authorities. On the other hand, the policy excludes pandemic risk.

Eventually, the court sided with the policyholders and required AXA France to pay a reserve of 49 000 USD.
